Police find no evidence of rape in downtown Athens investigation

ATHENS, Ga. — Athens-Clarke County police say investigators found no evidence that a rape occurred in connection with an incident reported last week near City Hall in downtown Athens.

The investigation began Aug. 21 after officers responded to a local hospital regarding a report of a possible sexual assault that allegedly occurred overnight. Detectives initially identified a person of interest but did not release that individual’s name.

Following what the Athens-Clarke County Police Department described as a thorough investigation, detectives concluded there was no evidence to support a rape charge.

Investigators did, however, uncover alleged fraudulent activity involving the victim’s financial transaction cards. The investigation has resulted in the arrests of two Athens men.

Police arrested 49-year-old Timothy Evans on Aug. 25 and charged him with financial transaction card theft, financial transaction card fraud and identity fraud. Authorities later arrested 40-year-old Dennie Smith in connection with the alleged card activity. Smith is charged with financial transaction card theft and financial transaction card fraud.

Police have not released additional details about the alleged fraud, including the relationship between the suspects and the victim.

“The Athens-Clarke County Police Department takes all reports of sexual assault seriously and appreciates the cooperation of those involved throughout the investigation,” the department said.
